You have paid your last car loan EMI. Congratulations, but you are not quite finished. Until you remove the hypothecation from your RC, the lender's name stays on your registration certificate, and that can cause trouble when you sell the car, transfer it or make an insurance claim. This guide explains what hypothecation is, the documents you need and how to get it removed, online or at the RTO.

What is hypothecation?

When you buy a car on a loan, the car is pledged to the lender as security. This is called hypothecation. The lender's name is recorded on the RC and with your insurer, which shows that the lender has a claim on the car until the loan is repaid. You keep and use the car; the lender just has a charge over it.

Once you repay the loan, the lender's claim ends, but the record does not update by itself. You have to apply to the RTO to cancel the hypothecation entry.

Why you should not skip this

  • Selling the car: a buyer, or the buyer's lender, will want a clean RC. Transfer of ownership can be held up until the hypothecation is removed.
  • Insurance claims: if the lender's name is still on the policy, claim payments may be routed to the lender, which adds delays.
  • A future loan against the car: refinance or a top-up needs a clean RC or the new lender's charge recorded properly. See loan against car explained.
  • Peace of mind: the RC shows you as the sole, unencumbered owner.

Documents you need

After the loan closes, collect these from your lender:

  • NOC (No Objection Certificate) addressed to the RTO, stating that the loan is fully repaid and the lender has no objection to cancelling the hypothecation
  • Form 35 (notice of termination of the hire-purchase or hypothecation agreement), signed by you and the lender
  • Loan closure letter or account statement showing nil balance

You will also need:

  • Original RC (or the details of your smart card RC)
  • Valid insurance certificate and PUC certificate
  • ID and address proof, usually Aadhaar
  • PAN or Form 60, if asked
  • Fee for the RTO service

The NOC is usually valid only for a limited period, often around three months. Apply before it expires, or you may have to ask the lender for a fresh one.

How to apply online

In most states, including Odisha, hypothecation termination is available through the Parivahan Vahan citizen services portal:

  1. Go to the Parivahan website and choose vehicle-related services for your state.
  2. Enter your vehicle registration number and verify with the OTP sent to your registered mobile number.
  3. Choose the service for hypothecation termination.
  4. Fill in the details and upload the NOC, Form 35 and other documents if asked.
  5. Pay the fee online and save the receipt.
  6. Book a slot or submit the originals at the RTO if your state requires physical verification.

Steps can differ slightly by state and RTO, so follow the instructions shown on the portal for your registration.

How to apply at the RTO

  1. Visit the RTO where your car is registered.
  2. Submit Form 35, the NOC, the original RC and supporting documents.
  3. Pay the fee and collect the acknowledgement.
  4. Collect the updated RC, or receive it by post, as your RTO advises.

Update your insurance too

Once the RC is updated, send a copy to your insurer with the NOC and ask them to remove the lender's name from your policy. Do this before your next renewal so the new policy is issued in your name alone.

Common problems and how to fix them

  • NOC expired: ask the lender to reissue it. Most lenders do this on request.
  • Mobile number not linked to the RC: update the mobile number on the Vahan portal first, so you can receive OTPs.
  • Car registered in another state: the application goes to the original registering authority. Check the portal for the right process.
  • Lender closed or merged: contact the successor bank or NBFC, which holds the old loan records.
  • Name mismatch: make sure the name on the NOC matches the RC exactly.

Frequently asked questions

How long does hypothecation removal take?

It depends on the RTO. Once documents are complete, it is often done within a few days to a few weeks.

Can I sell my car before the loan is closed?

Yes, but the loan must be settled as part of the sale. The buyer or the buyer's lender pays off your loan, you get the NOC, and only then can ownership transfer.

Do I need to remove hypothecation if I foreclose the loan early?

Yes. The process is the same whether the loan ended on time or you foreclosed it early.
